Agreement to Terms

You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms of Use, and you waive any right to receive specific notice of each such change.

User-Generated Content Safety

Our app includes user-generated content and we take specific steps to moderate content and prevent abusive behavior. By using the app, you agree to our terms that make it clear there is no tolerance for objectionable content or abusive users.

We have implemented the following precautions to ensure a safe environment for all users:

Users must agree to our terms which clearly state that objectionable content or abusive behavior will not be tolerated
We use automated filtering methods to detect and prevent potentially objectionable content from being posted
Users can flag objectionable content through in-app reporting mechanisms
Users can block other users who are behaving abusively
We act on all objectionable content reports within 24 hours by removing the content and ejecting the user who provided the offending content

The Coffeeopia's Case System

The Coffeeopia provides a case system in the unlikely event that your order does not go as expected. By using The Coffeeopia's case system, you understand that The Coffeeopia may use your personal information for the purpose of resolving disputes with other members. You can use The Coffeeopia's case system to come to a resolution with the roaster in the event of a non-delivery or if an item you receive is not as described in the listing.

If you choose a refund as your preferred resolution, keep in mind that The Coffeeopia only allows on-platform refunds for a period of 60 days post-transaction. After this 60 day window has elapsed, The Coffeeopia can't support on-platform refunds for your order. Refunds issued by The Coffeeopia will be in your original form of payment.

Non-Delivery

A non-delivery occurs when a buyer places an order but does not receive the item. The following are examples of non-delivery cases:

There is no proof that the item was dispatched to the buyer
An item was not sent to the address provided on The Coffeeopia

Not as Described

An item is not as described if the buyer can demonstrate that it is significantly different from the roaster's listing description or photos. Here are a few examples of not as described cases:

The item received is a different name, origin, roast type, process or size
The roaster failed to disclose that an item is damaged or is missing beans
The buyer received the incorrect quantity of items (e.g., the buyer purchased three items but only received two)
The condition of the item is misrepresented (e.g., the item is described as new but is used)

Ineligible Transactions

Some disputes don't qualify for The Coffeeopia's case system. These include:

Items that are damaged by the delivery carrier (if properly packaged by the roaster)
Items that have been altered or discarded
Items that are received after the agreed-upon delivery date due to delivery delays
Items that are returned without a return agreement
Items that are accurately described but don't meet a buyer's expectations
Cost of delivery disputes
Items that are purchased in person
Items prohibited from sale on The Coffeeopia, including services and intangible goods
Transactions where payment is not made via The Coffeeopia's checkout system

Your Rights as a User

As provided by the General Data Protection Regulation, you have the right to:

Access personal data regarding you. You can always access your account to review the personal data we have collected about you
Ask for rectification of incorrect or inaccurate data concerning you, or to have incomplete personal data completed
Ask for erasure of personal data regarding you (under certain circumstances)
Ask for the restriction of the processing of your data (under certain circumstances)
Object to the processing of your data for marketing purposes by withdrawing your personal consent
You can at any time withdraw your consent by deleting your profile or delete your account in the in-app settings

Governing Law

These Terms of Use and your use of the Site are governed by and construed in accordance with the laws of the State of Delaware applicable to agreements made and to be entirely performed within the State of Delaware, without regard to its conflict of law principles.

THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. Limitations of Liability
